Candidate Terms And Conditions

INTRODUCTION

Terms of Business For those wishing to gain employment permanent or temporary worldwide.

These Terms & Conditions represent a legally binding contract between the employment seekers (“the Candidate”) and TGNC (“the Agency”). The  employers and/or families referred to collectively as (“the Client’) unless specified otherwise. The child carer is referred to as she, but applicants can be male or female.

The parties hereto agree that this contract shall be governed by the law of England and Wales and to submit to the jurisdiction of the courts of England and Wales.

The Agency acts as an intermediary only and is not the employer. By signing up with the Agency, the candidate accepts these terms and conditions.

Any fees stated are subject to change without notice at any time. Fees are not subject to VAT.

 No variations of these terms and conditions shall be binding unless expressly confirmed by the Agency in writing.

Any variation of this Agreement (including any special terms and conditions agreed between the parties) must be agreed in writing between the parties.

DEFINITIONS

“Agency” means TGNC (The Good Nanny Company)

“Placement Fee” means the relevant fee payable to the Agency for the Services provided to the Client/Candidate.

“Candidate/Child Carer” means a person introduced by the Agency to the Client as requested for the purposes of employment as a nanny, mother’s help, maternity nurse or a person seeking domestic employment (or any other professional requested) on a temporary or a permanent basis, whether full or part time.

“Client” means the client named on the Client Registration Form for whom the Agency has agreed to provide the Services in accordance with these Conditions.

“Client Registration Form” means the form completed by the Agency during the Client’s consultation, using the details provided by the Client and sent to the Client with these Conditions.

“Conditions” means the terms and conditions of supply of Services as set out herein and any subsequent terms and conditions agreed in writing by the Agency and the Client.

“Introduction” means the passing by the Agency to the Candidate of Client profiles or other information in relation to a Clients.

“Services” means the services provided by the Agency to the Candidates as described in these Conditions.

REGISTRATION AND ACCOUNTS

Please be sure when giving your employment history to The Good Nanny Company (TGNC) ensure that all details are correct so that your requirements may be met and you are not misrepresented.

Once the Candidate has had an offer of employment from a Client introduced by The Good Nanny Company (TGNC) they must inform the agency within 24 hours notice of offer, so not to become liable for the placement fee.

The candidate will only commence employment with a client once payment of clients invoice has been received by the agency, therefore confirming the placement. TGNC will contact the candidate as soon as the placement has been confirmed, by email. Please do not commence employment with a Client from TGNC until they agency have confirmed and have a contract in hand for the candidate.

Client’s confidential information is sent for the express purpose of the current position you have requested to apply for with The Good Nanny Company (TGNC). Should you choose to pass on these details to a third party or take up employment the client yourself at a later date therefore bypassing the agency you will be charged the appropriate fee for any subsequent engagement that occurs. The Good Nanny Company (TGNC) are not responsible for any interview expenses howsoever incurred by the client.

By registering with the Agency the candidate acknowledges and accepts these Conditions. Any and all business undertaken by the Agency is transacted subject these Conditions.

FEES

In a normal circumstance, the agency does not charge the candidate any fees for using the agency to seek employment. It is a free service, as long as they stick to the terms and conditions of this document.

 

When a candidate would be charged;

Should a candidate take up employment with a client introduced to them via the agency and subsequently bypass the agency the candidate will be liable to pay a ‘Bypass Fee’ for £199.00.

To avoid this fee being charged to the candidate, the candidate should keep the agency well informed of the steps through their recruitment process for all agency clients.

TRIALS

Clients will be responsible for paying the candidate an hourly standard wage for their time spent working during a trial. The client will also be responsible to pay the candidate’s reasonable travel costs, should the candidate be able to supply the client with valid receipts.

TEMPORARY PLACEMENTS

A placement is considered temporary when registering a position for specified dates that do not exceed 2 weeks.

If a booking is cut short or cancelled, the agency will request the client pays the candidate for the time booked in, if there is less than 30 days before the booking is due to commence.

SALARY

The Agency will refer to their candidates expected weekly wages in net terms, it is the clients’ responsibility to ensure that they are clear on all payments that they will lawfully be required to pay on behalf of their employee to HMRC.

Those offering a service on a self employed basis should offer a regular invoice to the client for hours worked.

We can offer guidance with regards to Tax and National Insurance due but we are not Tax advisors and the Client/candidate should seek advice from a professional with regards to what Tax and National Insurance is due.

AGENCY OBLIGATIONS

Agency Obligations to the Candidate

  • To provide the candidate with full job descriptions
  • To provide candidates with clients that have registered by the Agency or partner agency and had their address verified
  • To arrange interviews between the Client and Candidates, if requested, via Skype or in person
  • To make offers to the chosen Candidate of the Client on the Clients behalf and confirm by email of the Candidates acceptance or decline
  • To supply the Candidate with a personalised contract of employment
  • To instruct the Candidate to make suitable travel arrangements for her arrival to the Clients home to commence work
  • To support the candidate throughout the duration of their role with the client should they need it

 

CANDIDATE OBLIGATIONS

Candidate Commitments To The Employer/Client

The candidates commits to respecting the following obligations:

  • To treat the employers home as your own, with the upmost respect
  • To take training, support and guidance from their employer as to how to carry out their duties well
  • Help the client manage the children and support them when the children don’t listen to them
  • To work all the hours as listed in your contract
  • To be timely, reliable and efficient with you role
  • To take 28 day’s paid holiday every 12 months
  • Give 2/4 weeks’ notice in case of termination of employment
  • Inform the Candidate of any surveillance cameras in the house
  • To take full and proper care of the employers home and children both on and off duty

 

Candidates Commitments To The Agency

The candidates commits to respecting the following obligations:

  • To supply the agency with truthful details about oneself and experience
  • To supply the agency with all relevant paperwork as requested
  • To accept a TGNC role with a Client’s family via the Agency and not independently
  • To ‘hold’ a job by filling out a Candidate Placement Confirmation form on our website at www.tgnc.co.uk/client-placement-confirmation once they have accepted a role with the Candidate.
  • To ensure that the candidate is 100% happy with their chosen client and to satisfy themselves with all the details of the role
  • To not pass on any details of any clients to a third party, doing so will result in the candidate paying a Third Party Referral Fee of £199.00
  • To confirm any changes (by email) of the role immediately
  • To return a signed contracted (by both Client and Candidate) to the Agency within 7 days of the Candidates start date by email
  • To contact the Agency with 48 hours of giving or receiving notice to/from the client
  • To supply reasonable grounds for wishing to change your chosen client

GENERAL

The Agency reserves the right to change these Terms and Conditions of Business without prior notification.

These Terms and Conditions of Business shall be governed by and construed in all respects in accordance with the laws of England & Wales and the Client agrees to submit to the exclusive jurisdiction of the English & Welsh courts.

Agency fee payments Method of payment accepted: Bank Transfers, all major debit cards (no handling fee) Major Credit cards (excluding Diners and Amex) are accepted and incur a 3.5% handling fee. Please note cheques are no longer accepted.
